terms and conditions comply with current legislation
and are designed to ensure that our customers
can shop easily and with confidence.
All
prices are in £ sterling, inclusive
of VAT and inclusive of delivery UK mainland
charges unless stated. Delivery charges can
be found under contact and support menu “Delivery”
They are also shown when you place an order
or quote in the upgrades or extras section.
You may pay by any major credit or debit card.
We are under no obligation to accept your
order. Prices, offers and products are subject
to availability and may change before (but
not after) we accept your order. |

| Terms and Conditions
of Sale of Products |
Please
read these terms and conditions carefully.
THE CONTRACT
When a customer purchases goods and places a order from
you as a trader, you are both entering into a legally
binding contract, which cannot be cancelled without
both parties' agreement.
They
contain very important information about your rights
and obligations, as well as warranty and liability limitations
that may apply to you.
By placing an order for Products,
you (“Customer”) accept and agree to these
terms and conditions.
A binding contract will only be
formed upon MNC giving notice of its formal acceptance
of an order.
Acknowledgment of receipt
of an order shall not constitute acceptance of an order.
Customer’s
(your) purchase of Products or Services, whether through
a the website or a telephone call centre, is subject
to these Terms and no other terms or conditions shall
apply. These Terms override any other terms or conditions
referred to by Customer or in any course of dealing.
Although
care is taken to ensure the accuracy of the information
on MNC websites, they could include inaccuracies or
typographical errors, including pricing errors. MNC
shall not be obliged to honour, nor be liable in respect
of, such errors. MNC and third party suppliers may make
improvements and/or changes in Products, Services, service
programs, prices and other details described, at any
time. Changes are periodically made to update MNC websites.

| ACCEPTING ORDERS
& SECURITY |
All
orders for Products placed by you with MNC Group are
subject to acceptance by MNC Group. MNC Group may in
its sole discretion accept or reject orders, or advise
you of its inability to process orders.
MNC
Group may send you an acknowledgement of receipt of
an order, by e-mail or other medium (including telephone).
Such an acknowledgement of receipt may be automatically
generated and shall not constitute an acceptance of
the order. MNC Group websites through which orders can
be placed may contain automatic means for identifying
and alerting you to certain types of input error before
you place your order. Such means may not identify all
errors or omissions and you should ensure that the information
you submit in your order is accurate and complete.
If
an order placed online through a MNC Group website,
by e-mail or by telephoning a MNC Group call centre
is accepted, MNC Group may advise of its acceptance
of the order by e-mail or other written form. MNC Group
reserves rights to acknowledge or accept verbally (by
telephone) telephone orders placed through its call
center or similar facilities.
Any
Contract is dependant and conditional upon MNC Group's
verification of availability and acceptance of both
your order and your credit card or other payment details.
Unless and until MNC Group confirms acceptance of both
of these items, MNC Group has no obligation to provide
any Products or Services. Where Customer has elected
to make payment other than with a credit card (and MNC
Group has accepted that payment option), MNC Group is
entitled to consider an order or Contract cancelled
with or without notice to Customer, if MNC Group does
not receive that payment within 10 days of the date
of the relevant order acknowledgement.
We
maintain records of orders, order acknowledgements and
Contracts (including these Terms and order acceptances)
and retain these for a reasonable period following delivery.
Whilst we may if necessary (and only on written request)
be able to provide you with a copy of your Contract,
these are not made generally available to Customers.
We recommend that you retain a printed copy of these
Terms with a copy and/or note of your order, order acknowledgment,
order acceptance, payment method acceptance and invoice
as evidence of purchase.
If
we decline your offer on security grounds we may contact
you to seek an alternative payment method.

| Software Licences
& Registering Products |
All
software, including pre-loaded software contained in hardware
Products, is licensed and not sold. It is licensed either
by MNC or the relevant software owner to you subject to
the relevant software end-user licence agreement or other
terms included with the software and/or with the Product
or Services. Software may not be disassembled, decompiled,
reverse engineered, merged or combined with any other
software, copied, translated, adapted, varied or modified
(save as expressly permitted by applicable law) nor may
it be distributed in any form.
Where
express software licence terms are not supplied, software
is licensed on a non-exclusive, non-transferable, single
user basis for use only with the accompanying Product.
If
you do not accept the terms of any applicable software
licence, subject to the exceptions , you should return
the Products unused and "as new" in accordance
with, and within the time period set out in, returns below.
Note: to qualify for a refund, shrink-wrap software must
not be opened or any product registered
MNC
or MNC Group Companies' guarantees or warranties do not
include the correction or avoidance of software defects
or errors or the loading or re-loading of Customer's applications
software or data or any reconfiguration of Products beyond
reloading the operating system software as installed in
the Products before shipment (subject to software availability).
If
the goods are not faulty and an order is cancelled after
despatch then you will be charged a 25% admin and restocking
fee. Back

| DELIVERY |
Delivery
is restricted to the United Kingdom, to the address to
which your credit/debit card is registered. All deliveries
made by Courier must be signed for and you should keep
your receipt. Delivery times and details about delivery
and installation can be found under 'Delivery' accessible
from the Contact and support Menu. Although we do everything
we can to meet the delivery times described in that section,
delivery times may be affected by factors beyond our control
and therefore cannot be guaranteed.
MNC
Group aims to deliver promptly. However, there may be
reasons for MNC Group's inability to ship according to
its target dates (most of which are beyond MNC Group's
control). Accordingly, any dates given by MNC Group for
the delivery of Products are estimates only, and MNC Group
cannot and does not undertake that delivery will occur
on any specified dates.
However, you have the option of cancelling your order
at any stage prior to despatch of your Products by MNC
Group. You may also have a right to return Products after
they have been delivered (see 'Your Right to Return and
Returns Policy' below).
If Products cannot be delivered by any estimated or target
dates given by MNC Group, MNC Group may elect to cancel
the order and refund any money paid by the Customer. If
an order is cancelled, MNC Group's only obligation shall
be to refund any money paid by the Customer to MNC Group.
Your
order will be with you in 3-10 working days. Sometimes
due to limited stock and high demand delivery time can
exceed this.

| CANCELLATIONS
& RETURNS |
THE CONTRACT
When a customer purchases goods and places a order from
you as a trader, you are both entering into a legally
binding contract, which cannot be cancelled without
both parties' agreement.
The
Sale of Goods Act 1979
A customer has no rights for those defects that are
brought to his attention before the sale, or if the
customer examines the goods before purchase and any
defects should have been readily noticeable.
A customer also has no rights if they damage the goods
themselves or simply change their
mind about wanting the goods. Also, if a customer
specifies the product he wants and doesn't rely on the
trader's expertise or ignores the advice of the trader,
he will not have a claim if the item is not fit for
the purpose.
It is illegal to try to exclude a customer's statutory
rights. However, you can make it clear that you
don't offer a policy relating to the return of goods
where the customer has changed their mind about wanting
the goods.
The
right of return and refund does not apply to software
sold with MNC products, or as a separate product, if
the licence seal has been broken and/or shrink-wrap
packaging opened. (2)The right of return and refund
does not apply to any product that as been registered.
If
a order is cancelled because you have simply changed
your mind then you will be charged a 25% admin and restocking
fee as you have entered into a contract and now want
to cancel the legally binding contract.
You
must obtain a MNC return reference number. This number
may be obtained from MNC website at (http://www.mynewcheap.co.uk/contact-support/returns-form.htm
or by telephone, on the contact number(s) mentioned
in MNC websites. You must return the Products to the
address and in the manner indicated on the return documentation.
The
MNC return reference number must be prominently displayed
on the outside of the parcel in which the Products are
returned to MNC. Your MNC invoice must be enclosed with
the returned Products.
You must prepay (i.e. prior to any reimbursement of
the Product price by MNC) the Product carriage/delivery
charges and assume all risk of loss and damage to Products
while in transit to MNC. " Delivery & Credit
Card Surcharge are non-refundable " If another
method of return is used you will be responsible for
the costs.
Products
must be returned in the original packaging, in "as
new condition", and with all component products,
parts, accessories, warranty cards, manuals and other
documents and items.
If you return Products (1) which have been damaged or
used, (2) without a MNC return reference number, (3)
after the 7 working-day returns period, (4) without
proper or with missing packaging, (5) parts of which,
including components, included products, accessories,
packaging, boxes, documents and/or other items are damaged
or missing, or (6) without pre-paid delivery, MNC retains
the right either to refuse to refund Product purchase
price or to charge you repair, restocking or related
fees and delivery charges. MNC may in that case deduct
those fees and charges from any payments to be refunded
to you.
On
return of Products, MNC will, subject to the above qualifications,
repay the actual amount paid to MNC, less any fees and
charges due to MNC (as per the above), by crediting
your relevant credit card or bank account less any Credit
Card Surcharge from original order placed (or other
means).
The issue by MNC of a return reference number shall
not constitute an acceptance or acknowledgment of any
right to return Products, except to the extent that
these Terms or mandatory applicable laws confer such
a right.

| MISCELLANEOUS |
Sales
on this web site are governed by English law and you agree
to submit any dispute to the non-exclusive jurisdiction
of the English courts. All orders are subject to these
terms and conditions, and no amendments will be accepted
by us.
These
terms and conditions only cover the MNC Group websites.
Any other web sites to which you link from this site are
governed by their own terms and conditions. We accept
no responsibility or liability for the content of web
sites that are not under our control.
These terms and conditions do not affect your legal rights.
We are required by law to tell you that sales can be concluded
in English only and that we do not file copies of customer
